Frank J. Brier

Frank Brier focuses his practice on all aspects of healthcare law, from corporate, regulatory and investigations to complex litigation. He has a wealth of knowledge and decades of experience from serving clients in private practice and as General Counsel and Litigation Counsel for Geisinger Health, an extensive healthcare system serving customers in Central and Northeastern Pennsylvania. Frank provides advice and advocacy to healthcare clients in relation to employment issues, insurance, professional medical liability, fraud and abuse, medical staff fair hearings, non-profit and health care compliance, electronic health records, peer review, privileging and credentialing, and professional licensing. He routinely represents individual and corporate entities in investigations, in litigation and on appeal.

Frank has over two decades of experience handling medically complex professional liability cases and has tried more than twenty-five complex medical malpractice cases to verdict in counties throughout Pennsylvania. In September 2020, Frank, led an MBK team to a defense verdict in the first civil jury trial to be held in Northeastern Pennsylvania since the start of the COVID-19 pandemic. He has obtained defense verdicts in jury trials involving allegations of negligence in obstetrics, primary care, neurology, oncology, cardiology, infectious disease, general surgery, nursing care, physical therapy, chiropractics, emergency medicine, radiology, hospital liability, pediatrics, critical care, and vascular care. He has led MBK teams to defense verdicts on behalf of a hospital in a jury trial involving a wrong-sided surgery; on behalf of an orthopedic surgeon in a jury trial alleging surgical negligence; and on behalf of a cardiothoracic surgeon in a jury trial involving alleged negligence in a coronary artery bypass graft procedure (with Nicholas Kravitz.)

Frank’s knowledge of, and experience in, the sphere of healthcare law is invaluable for a broad range of client issues. Frank assists healthcare clients in numerous matters such as regulatory issues, employment, and white collar crimes. Together with Nicholas Kravitz, Frank successfully obtained appellate enforcement of a covenant not to compete in a physician’s employment contract. In collaboration with Dan Brier and Pat Casey Frank obtained a favorable outcome for a physician charged federally with criminal distribution of a controlled substance. With MBK partners Dan Brier and Jack Dempsey, Frank obtained a $10 million confidential settlement for the estate of an individual in a wrongful death matter. Frank has also represented multiple behavioral health providers in resolving payment audits by third-party payors.

Frank has been honored as a Fellow of the American Bar Foundation. This distinction is awarded to attorneys, judges and law professors whose professional, public and private careers have demonstrated outstanding dedication to the welfare of their communities and to the highest principles of the legal profession. He has also served as president of the Northeastern Pennsylvania Trial Lawyers Association and has been repeatedly selected to the list of Pennsylvania Super Lawyers.
