The United States Court of Appeals for the Third Circuit recently affirmed the granting of summary judgment in favor of MBK’s healthcare client on a former employed physician’s contract claims. The physician asserted breach of contract and promissory estoppel claims premised on the healthcare entity’s purported breach of certain terms of a separation agreement. Finding no evidence of such a breach, the trial court granted summary judgment in favor of the healthcare entity and the Third Circuit affirmed that decision. The Third Circuit also rejected the physician’s challenges to the denial of motions to compel and for leave to file a third amended complaint.
