MBK provides skilled advocacy and representation for appeals in civil and criminal matters. We know the law, we respect it, and we push it to its limits in the zealous protection of our clients’ rights.
Our Appeals team is comprised of seasoned practitioners with a reputation for effective strategy and skilled written and oral advocacy. We pursue and defend appeals in civil and criminal matters in both state and federal appellate courts and collaborate with attorneys firmwide on specific areas of substantive law and legal procedure including employment law, healthcare, and white collar criminal defense.
Our attorneys have pursued and defended appeals in courts throughout the Commonwealth including Pennsylvania’s Supreme, Superior and Commonwealth Courts and the U.S. Court of Appeals for the Third Circuit. We represent individuals, employers, business entities, non-profit organizations and government agencies and officials on a broad spectrum of appellate-related issues, including pre- and post-trial motions, requests for reconsideration, drafting statements of errors complained of on appeal, drafting petitions for allowance of appeal and for permission to appeal as well as petitions for writ of certiorari, and briefing and arguing appeals in all levels of federal and state court. The Appeals team is also experienced in drafting amicus briefs on behalf of organizations supporting various appellate positions.
In approaching any appellate matter, our attorneys will initially analyze and evaluate the merits of the claim, strategically identify the pertinent appellate issues and most promising arguments, and develop a strategy best suited to the particular claim and forum. We continue this strategic analysis behind the scenes throughout every representation. On the surface, however, the result of this work, together with our in-depth knowledge of the law and our zealous representation of our client, is clearly evident in the compelling written briefs and eloquent oral arguments that we put before the court.
Our appellate practice is distinct from our litigation practice but they work in harmony. Our appellate attorneys frequently advise at the trial stages of a matter to discern effective strategies and to identify and preserve issues that could be critical if the matter proceeds to appellate review.
