Myers, Brier & Kelly, LLP defeated a Preliminary Injunction on behalf of its client the Wilkes-Barre/Scranton International Airport filed by its former fixed base operator (“FBO”) Saker Aviation Services, Inc. (“Saker”). Saker attempted to enjoin the Airport from awarding a new FBO contract to a third-party. Following a hearing, Lackawanna County Common Pleas Judge, Hon. Peter J. O’Brien, denied Saker’s preliminary injunction holding that the Saker FBO lease agreement was not exclusive. In denying the injunction, Judge O’Brien found the lease agreement was unambiguous and established no obligation to afford Saker the right to continue as the Airport FBO.
