MBK wins major federal criminal trial in Harrisburg

Bill Fetterhoff of MBK obtained an acquittal on all counts in a federal criminal jury trial on Wednesday.

In United States v. Dennis Lee Charles, Jr., MDPA No. 1:20-CR-20, the United States Attorney for the Middle District of Pennsylvania (Harrisburg) filed a six count indictment on January 22, 2020 charging multiple violations of the Clean Air Act.  The indictment alleged improper disturbance of asbestos and alleged failures to follow U.S. Environmental Protection Agency (EPA) work practice standards related to the abatement of asbestos at an old weaving mill in Berwick, Columbia County, PA.  The case was tried before a jury over a period of seven days.  Judge Jennifer P. Wilson dismissed two counts of the indictment at the close of the Government’s case.  On June 22, 2022 the jury returned verdicts of not guilty in favor of Mr. Charles on all four of the remaining counts.  The jury likewise returned verdicts of not guilty on all counts for the other two defendants at trial.
