Myers Brier & Kelly Continues Expansion With Hiring of Department of State Chief Counsel Timothy E. Gates

Myers Brier & Kelly, LLP, a boutique law firm representing companies, individuals, and government agencies and officials in complex litigation and transactional matters, has announced that Timothy E. Gates will join the firm’s litigation, voting rights, and consumer protection practice groups.  Gates will be a resident of the firm’s Harrisburg office.

Gates is an Army veteran, having served with distinction in the 82nd Airborne Division.  Following his commended military service, Gates spent nearly two decades as a lawyer in state government, with a focus on litigation, investigations and consumer protection.  His deep subject-matter experience will bring tremendous value to MBK and the firm’s clients.

Gates began his professional legal career as an attorney for the Commonwealth of Pennsylvania Office of Attorney General (OAG) where he conducted consumer protection, Medicaid fraud, and elder abuse investigations.  His efforts prosecuting violations of Pennsylvania’s consumer protection laws resulted in recovery of more than $17.6 million on behalf of Pennsylvanians.  Additionally, he served as the OAG’s designated member on ten multistate consumer protection cases brought by the National Association of Attorneys General which resulted in nationwide settlements worth $346 million.  Gates next served as Chief Counsel for Litigation at the Commonwealth’s Department of Corrections.  While at DOC, Gates managed the agency’s involvement in over 500 litigation matters in state and federal courts, dozens of jury trials as well as several precedent-setting appeals to the U.S. Court of Appeals for the Third Circuit.

Most recently, Gates served as Chief Counsel to the Commonwealth of Pennsylvania Department of State, where he managed the largest executive agency legal office consisting of 73 attorneys and 50 support staff.  At the Department of State, he supervised and directed legal services related to business and charitable organizations, campaign finance, and professional licensure prosecutions.  Among other high stakes litigation matters, Gates managed and directed the successful defense of dozens of cases in state and federal courts arising from the 2020 Presidential election and 2022 general election, including constitutional challenges to the Commonwealth’s mail-in voting statute.
