MBK Prevails on Appeal in Pennsylvania Superior Court

The Pennsylvania Superior Court affirmed a verdict that MBK secured for a client in the trial court.  Suzanne Scanlon prevailed in obtaining summary judgment as to liability in a breach of contract action through requests for admission which were deemed admitted.  The court later held a damages hearing where Suzanne successfully recovered the entirety of the client’s damages.  On appeal, the opposing party challenged the use of the deemed admissions and raised evidentiary issues relating to the damages hearing.  Following briefing and Nick Kravitz’s oral argument, the Superior Court rejected all of the arguments and affirmed the trial court’s decision.  The opinion demonstrates that deemed admissions can be effectively utilized and highlights the significant risk to practitioners if requests for admissions are not responded to in a timely manner.
